Customer Agreement for RingBack Memories Audio Guestbook Rental Services
This Customer Agreement ("Agreement") is entered into between RingBack Memories] ("Company") and the undersigned customer ("Customer") for the rental of a vintage phone for an audio guestbook. By booking our services, the Customer agrees to the following terms and conditions:
RingBack Memories agrees to provide the following services to the Customer:
The total booking fee for the services is $399, which includes:
Prices do not include applicable taxes, which will be added at checkout.
Customers have two payment options:
Option 1: Full Payment
The full $399 booking fee is due at the time of reservation to secure the rental. No services will be rendered until payment has been received in full.
Option 2: Deposit Payment
The Customer may opt to pay a deposit of $25 at the time of booking. The deposit will reserve the Customer's event date. The remaining balance of $374 will be automatically charged 60 days after the initial deposit or 14 days before the event, whichever is sooner.
No services, including phone shipment or editing, will be provided until the full booking fee is received.
RingBack Memories will ensure that the phone is shipped to arrive at the Customer’s specified address at least four (4) days before the event date. The Customer agrees to provide accurate and complete shipping information upon booking. The Company is not responsible for shipping delays due to incorrect or incomplete address details provided by the Customer.
RingBack Memories will reach out no later than four (4) weeks prior to the event date to collect the Customer’s custom greeting message. If the greeting is not submitted two (2) weeks prior to the event date, RingBack Memories will use a generic greeting for the event.
The Customer agrees to ship the phone back to RingBack Memories within three (3) days after the event using the prepaid shipping label provided by the Company. The Customer is responsible for packaging the phone securely and delivering it to the shipping carrier on time.
If the phone is not shipped back within the three (3) day period, the Customer will be charged a late fee of $50 per day until the phone is shipped. If the phone is not returned within 10 days of the event, the Customer will be charged the replacement value of the phone, which is $800.
The Customer agrees to take reasonable care of the vintage phone while it is in their possession. The Customer is responsible for any damage or loss that occurs while the phone is in their custody. If the phone is damaged or lost, the Customer will be responsible for repair or replacement costs, up to the full replacement value of $800.
RingBack Memories will edit the audio messages recorded during the event and provide the final edited audio to the Customer in the form of:
The editing process may take up to one week after the event. The vinyl record and USB will be shipped to the Customer within six weeks after the event.
Cancellations made at least 30 days before the scheduled event will receive a full refund. Cancellations made less than 30 days before the event are non-refundable. If the phone has already been shipped, the Customer will be responsible for returning the phone in unused condition within 7 days of cancellation.
RingBack Memories is not liable for any technical issues, shipping delays, or loss of audio messages due to user error or misuse of the phone. In the event of equipment failure, the Company will provide a refund of the rental fee or reschedule the rental, at the Company’s discretion.
This Agreement shall be governed by and construed in accordance with the laws of Virginia, United States. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Virginia, United States.
By accepting these terms, the Customer acknowledges that they have read, understood, and agree to all terms and conditions outlined in this Agreement.
